The FSSAI maintains and promotes public health by regulating and supervising food safety across the country. They do this following the guidelines of the Food Safety and Standards Act, 2006 which is an Act with information about food safety and regulations.

Food Safety and Standards Authority of India is an autonomous body established under the Ministry of Health and Family Welfare, under the Government of India. It is headed by a non-executive Chairperson, appointed by the Central Government, either holding or has held the position of not below the rank of Secretary to the Government of India. Being in charge of the entire country, they have their main office in Delhi. They also have smaller regional offices across the country, like in Delhi, Guwahati, Mumbai, Kolkata, Cochin, and Chennai.

Each Indian state has its own State FSSA under the Act. Every FSSAI registration and State FSSAI license are issued by the state FSSA in which business operations are set up. The central FSSAI license is issued by the main FSSA authority.

What constitutes an eating house?

Any permanent or temporary establishment that sells food can be termed as an eating house. These could be shops, restaurants, dhabas, food trucks, street food shops, bars, clubs and the likes. Additionally, food or refreshments of any kind, not including spirits, wines, beer, or other forms of malt liquors are sold for consumption. If liquors are being served or sold, the procedures change significantly since there are additional licences and liquor permits that are needed.

What is an eating house licence?

For any of the above-mentioned establishments to legally run and operate, they would need to apply for a licence and permit. This is a mandatory requirement and not something that they can choose to apply for. Made compulsory through the Delhi Police Act, if places are trying to function without the necessary paperwork, they could find themselves shut down permanently, their equipment confiscated and massive fines imposed. These licences have to be applied for under the state of city headquarters. The registration authority concerning Eating House Licenses is the Commissioner of Police and would have to handle this in their respective state.

How do individuals planning on running food establishments apply for a licence?

The best part of the licences at the moment is that there are applications that allow people to apply for them online and that saves them the time of having to coordinate with the office and make multiple trips. However, there are a few trips that they have to handle. This can be done on the police website of the state that an applicant is applying from.

The entire process is two-step and needs people to register their establishment to the website before they can apply for the licences that they would need. All they would have to do is fill out the details asked in the forms. At some points, they have to upload supporting documents that make the process easier and the entire processing and verification process would take place in the backend.

What would the rest of the steps to make the licence a possibility be?

Post submitting all the details and documents needed, applicants would have to pay their fees. After the fees of approximately Rs. 300 have been paid, if there have been errors on the forms, or the information has been misrepresented, the amount paid would be forfeited.

The process does take anywhere between 30 to 90 days. After submitting all the information, this has to be actively followed upon. The validity of an eating house licence does vary based on multiple factors like the type of establishment being run, for instance, food trucks would have shorter expiration dates for their licences as compared to restaurants. Usually, however, the default for most venues is three years.

While approaching the expiration date of the licence, the establishment would need someone to work on the process of renewing it. Unlike most other Government documents, the eating house licence does not have a renewal form. It would have to be done like the process of applying for the licence from the get-go. This does take time so it would be better to begin a little better the actual expiration of the licence.

What are some of the documents needed for the application process?

We have mentioned a list of documents that applicants should keep handly before they begin the application process for their licences.

  • Proof of identification such as PAN Card details, Passport, Voter ID, drivers licence and so on.
  • Proof of residence such as Passport, Voter ID, Government bank account etc.
  • Proof of ownership or lease documents if the land is being rented.
  • Registration documents of the company or establishment to prove that it is valid.
  • Self-attested no objection certificate (NOC) from the owner of the premise, if it is being rented out for an eatery.
  • Trade License from NDMC/DCB/MCD/Airport Operator depending on the location of the establishment.
  • Certification of Incorporation of the companies and LLP.
  • Memorandum of Association of the eating house and LLP.
  • Complete list of Director or Partner Names and the current Form 32.
  • The nomination of the Authorised signatory on the company’s letterhead. This could be more than one individual.
  • Resolution of the board for conducting business.
  • Copy of the FSSAI license/registration papers.
  • Updated GST registration certificate.
  • Certificate of registration issued by the Labour Department, GNCT of the state.
  • Fire Safety Certification applicable for eating houses, seating a minimum of 50 people at a time.
  • List of all employees working in the eating house including food handler details – their name, parentage, and address.
  • Consent Letter from the DPCC (a provisional license provided based on the application submission proof).
  • Approved site plan with Fire Safety measure certificates.
  • Self-attested prescribed Affidavit for issuing a fresh license.
  • Police Clearance Certificate (PCC).
  • Permissions from the Indian Performing Right Society (IPRS), for having amusement activities like DJ, Live Band, and Discotheque.
  • Proof of CCTV or surveillance systems installed along with at least 30 days of video recording having the details of installation or invoice of CCTV, etc.
  • Photographs of the allocated space.

These are all the major documents that could be needed. If some of the documents have been submitted under one category, they cannot be used again. For instance, if a passport has been used as an identification proof, it cannot be used for an address proof as well and would have to be substituted with something else.
